1.3 Bookings for training and consultations are also governed by our training and consultation booking terms. How we handle personal information is explained in our privacy notice and cookie policy. Paid consulting engagements are governed by a separate signed proposal or engagement letter.
1.4 Important clauses. Clauses that limit our liability, place risk on you or require you to indemnify us are printed in bold. Please read them carefully. Nothing in these terms limits any right you have under the Consumer Protection Act, 2008 (CPA) or the Electronic Communications and Transactions Act, 2002 (ECTA) that cannot lawfully be limited, and these terms must be read so that they comply with those Acts.

3. Intellectual property
3.1 This website and its content, including text, articles, essays, course descriptions, graphics, layout, design, tools, video and software, are © BS Vision (Pty) Ltd. All rights reserved. Content is owned by us or used under licence, and is protected by the Copyright Act, 1978 and other laws.
3.2 We give you a limited, non-exclusive, non-transferable and revocable licence to view the website and to download or print individual pages for your personal use or for internal use within your organisation, provided you keep all copyright and other notices intact and do not change the content.
3.3 Without our prior written permission, you may not:
- copy, republish, sell, sub-license or distribute any content, in whole or in substantial part, including on another website, in training material or in a paid product;
- scrape, harvest or systematically extract content or data from the website, whether by hand or by automated means, including to train or feed artificial intelligence systems; or
- frame the website or present its content as your own.
3.4 You may quote short extracts from our articles with a clear acknowledgement of BS Vision as the source and a link to the original page. To ask for permission for anything else, email sales@bsvision.co.za.
3.5 "BS Vision", "BS Vision Corporate Consulting", "The Blueprint", "The blueprint of change" and our logos are our trade marks, whether or not registered. You may not use them without our written permission.
3.6 The names and logos of clients, partners and other organisations shown on this website belong to their respective owners. Their appearance does not mean that those organisations endorse us or this website, or that we claim any right in them. Photographs are used under licence and may not be reused.
4. Content is general information, not advice
4.1 Articles, essays, guides, tools, calculators and other content on this website, including the Knowledge hub, are general information only. They are not legal, tax, accounting, financial or investment advice, and they do not create a client relationship with us.
4.2 The B-BBEE Codes of Good Practice, sector codes, employment equity rules and other laws change, and their interpretation develops. Figures, targets and examples reflect the Codes and the law as we understood them at the time of writing and may since have changed. Before acting, please confirm the position with your verification agency, your own legal and tax advisers, or by engaging us formally.
4.3 Figures, company names and results shown in the illustrations and demonstrations in the AI section of this website are fictional and are included for illustration only. They do not describe any real organisation or predict any result.
4.4 BS Vision structures, arranges and facilitates funding through registered funding partners. We are not a lender, a credit provider under the National Credit Act, 2005, or a financial services provider under the Financial Advisory and Intermediary Services Act, 2002, and we do not give financial advice. Any funding is provided by, and on the terms of, the relevant funding partner, which makes its own credit decision.
4.5 We do not guarantee any particular B-BBEE level, verification outcome, employment equity result, grant, funding approval or tax benefit. Results depend on facts and decisions outside our control, including those of your verification agency, funders and authorities.
5. Availability of the website
5.1 We take reasonable care to keep the website accurate, available and free of harmful code, but we provide it "as is" and "as available". To the extent the law allows, we do not warrant that it will be uninterrupted, error-free or always up to date.
5.2 We may change, suspend or withdraw any part of the website, or any course or service it describes, without notice. This does not affect a booking we have already confirmed in writing, which is dealt with under our booking terms.
5.3 You are responsible for your own devices, software and internet connection, and for using up-to-date security software.
6. Limitation of liability
6.1 To the fullest extent the law allows, BS Vision, its directors, employees and agents are not liable for any loss or damage, whether direct, indirect or consequential, arising from your use of, or reliance on, this website or its content, or from the website being unavailable, except where the loss or damage is caused by our gross negligence, wilful misconduct or fraud, or by that of a person acting for or controlled by us.
6.2 Where we are liable in connection with a paid service, our liability is limited to the amount you paid for that service, except where the law does not allow such a limit. Liability for paid engagements is otherwise governed by the relevant engagement letter or our booking terms.
6.3 Nothing in these terms excludes or limits any liability that cannot be excluded or limited by law, including under sections 48 to 51 and section 61 of the CPA where it applies to you.
7. Indemnity
If you breach these terms, or use the website unlawfully, you agree to compensate us for any reasonable loss, damage or costs (including reasonable legal costs) we suffer as a direct result, to the extent the law allows.
8. Links to other websites
This website links to websites and services we do not control, such as funding partners, government departments, YouTube and news sources. We provide these links for convenience only. We are not responsible for their content, availability, security or privacy practices, and a link does not mean we endorse them.
9. Acceptable use
You may not:
- use the website for any unlawful, fraudulent or harmful purpose, or in a way that infringes anyone's rights;
- try to gain unauthorised access to the website, its server or any connected system, or to test, probe or breach its security, including any act prohibited by the Cybercrimes Act, 2020 or Chapter XIII of ECTA;
- introduce viruses, malicious code or anything else that may damage or disrupt the website;
- submit forms automatically, in bulk or repeatedly, or submit false, misleading or another person's information without their authority;
- use the forms or our contact details to send spam or unsolicited marketing; or
- interfere with other people's use of the website.
We may block access, reject submissions and report unlawful activity to the authorities.
10. Electronic communications
10.1 You agree that we may communicate with you electronically. Emails and website form submissions are data messages under ECTA. A data message is treated as sent and received as set out in section 23 of ECTA, which means it is received when the complete message enters the recipient's information system and is capable of being retrieved and processed by them.
10.2 Submitting a form, or sending an email, is a request or an offer only. No agreement comes into existence until we confirm it to you in writing (by email or a signed document), as section 22 of ECTA allows. An automatic acknowledgement of receipt is not a confirmation.
10.3 Statements of intent and agreements in electronic form are valid under section 24 of ECTA. Where we both sign a proposal or engagement letter, an electronic signature is acceptable unless the law requires otherwise.
10.4 You are responsible for giving us accurate contact details. Please check your junk mail folder if you expect to hear from us.
11. Governing law and jurisdiction
11.1 These terms are governed by the law of the Republic of South Africa.
11.2 Subject to clause 11.3, you and we agree to the jurisdiction of the High Court of South Africa, Gauteng Division, Johannesburg. We may also choose to bring a claim in a Magistrate's Court with jurisdiction over you.
11.3 If you are a consumer under the CPA, nothing in this clause limits your right to refer a dispute to the National Consumer Commission, a provincial consumer protection authority, an accredited ombud, a consumer court or any other forum the CPA allows, or your right to bring proceedings in a court with jurisdiction over you.
12. General
12.1 Severability. If any provision of these terms is found to be invalid or unenforceable, it will be limited to the extent necessary or removed, and the rest of the terms will continue to apply.
12.2 No waiver. If we do not enforce a right immediately, we have not given it up.
12.3 Changes. We may update these terms from time to time by publishing a new version on this page, with the date at the top. The version in force when you use the website applies to that use. Changes do not affect a booking already confirmed in writing.
12.4 Whole agreement. These terms, with the documents referred to in clause 1.3, are the whole agreement between you and us about your use of the website.
13. Complaints and contact
If you have a complaint or a question about these terms, please contact us first at sales@bsvision.co.za or 010 500 0909. We will acknowledge your complaint promptly and try to resolve it fairly. Legal documents may be served at the address in clause 2.
